I went to automax atlanta on Sunday 4/23/17 to inquire about vehicles, to get prices, and potentially test drive vehicles. I was greeted by two sales reps, one being Tyce Ellis and another with a ponytail, who advised me they would assist me on that day. After explaining my current credit situation (being that I had an open car loan and that it was on a Sunday--a day most financial institutions and banks are closed), I let them know that I did not want to purchase a vehicle that day, rather to only look and get price points. I was advised by the ponytail sales rep that I would need to fill out a credit application, to have the app looked at internally but not sent out to financial institutions/banks as a hard inquiry. He advised me that Tyce would take over at that point. So I proceeded to fill out the "soft" credit application under the pretense that it would not be sent to any 3rd parties, banks, or financial institutions as a hard inquiry. At that point, Tyce, Tommy (my moms boyfriend) and I went outside to look at a few vehicles, while my mom waited inside. We viewed a maxima, and waited for others to finish viewing a lexus. When we returned inside, the application was finished but I was advised that wed need to wait for the finance manager to speak further regarding my options, to see if the application was even worth sending out to banks/financial institutions (basically to run the credit application). After about 20 minutes of waiting for the finance manager and other customers to finished viewing the lexus, my mom, her boyfriend, and I decided to leave the dealership and call back at a later time to discuss with the finance manager the results of the internal "soft" credit application. Approximately a few weeks later, on around 5/3, I looked at my credit using Credit Karma to find that automax atlanta had submitted my credit information to CredCo, a vendor financing company, as a hard credit inquiry without my full understanding to consent to a hard inquiry. Essentially, I feel this is consumer fraud to generate fake sales leads for credit applicants who dont pursue financing through automax atlanta. My information has been used under false pretenses and submitted to a third party vendor without my full knowledge. I do admit that I submitted the credit application and allowed automax to photocopy my ID, but under a lie and a false pretense that they would NOT run my credit to any 3rd parties, who I may not want to have my personal information such as a SSN or phone #s. I believe automax should be investigated for committing consumer fraud because they are fraudulently using customers information under misguided and false representations to fake sales leads which will help them to maintain relationships with investing vendor companies who do finance business with them. My information should not have been sent to any 3rd parties without my full knowledge of where it was going, as the 2 sales reps indicated that this information was for internal use only. After confirming with CredCo that automax had submitted my information for a hard credit pull and to request a deletion letter from automax, I contacted automax and was given the run around as to how to get the deletion let and was referred to Equifax. After contacting equifax, I was referred back to automax to take steps in deleted the credit inquiry pull that was misrepresented to me. Automax should be investigated because they are not providing due diligence as company to customers by taking peoples information under misrepresentations and false pretenses.

SOLD CAR KNOWING OF REAR DIFFERENTIAL ISSUES AND NOT INFORMING SELLER purchased 06 chevy impala on 07/22 for 6500 cash.. advised the car was in great running condition. they fixed brakes which were scrubbing before purchase was final. The following morning i called informing of the awful noise coming from rear of car and they advised me to bring it back in on Monday and let them make sure brakes (which they ahd replaced at time of purchase) and catpillars were ok. On Monday 07/24 car was taken back in and ray - max and jose stated they would replace callipers and gave a loaner car to driver. we picked the car up on 07/26 and they stated they purchased a warranty since they did not hear the sound were were telling them about they didnt want us to have any issues with the running of the auto. we left and once again the noise started, which ray had told mr price if the noise happens again call us we want to make it right.we called the warranty after finding out the noise we are hearing is the rear differential (rear end) falling out of car. the warranty doesnt not cover this because it is an existing issue and the warranty is only been effective for 2 weeks and we will have to pay for the repairs. when i call and inform of the noise again like we had been instructed by ray i am told their hands are tied and there is nothing else they can do for us. after being told if the noise continues, call us and bring it back since wehn they had it to repair the callipers they didnt hear the noise, and here is warranty which is not worth a crap. when i called 08/07 and explained that the warranty would not cover this repair, jose states his hands are tied and that he mentioned to ray that i had called and that there is nothing else they can do for me. this place wants to show honesty and integrity, however 6500.00 cash and told car is in working condition? now i have a car sitting in the driveway thats paid for but not driveable? i am devastated at the lies of honesty they give and stated they would never leave someone stranded after paying cash and yet this is exactly what they have done.ty stated the day we bought the car that they do not and ill not sell a car that isnt safe, has major issues, or repairs that someone wouldnt be able to fix because of the cost of reapris, was it ever offered for me to look at another car on their lot for the amount of money i have given them and was driveable, NO ....was it offered to split the cost or repair the car as they had stated they would.. NO.... No i have a car that will sit because all cash was given to purchase the car that is not driveable...

Jose assisted be in getting to his location 3 times(since my gps was not picking it up) and had EXCELLENT customer service! I arrived to the lot saw the car I came for snd asked to test drive and who I had been dealing with...they gave me to a spanish women named Lucy who had NO personality, No customer service no smile. She did not KNOW her product and just couldnt grasp the fact that I was a serious buyer. She treated ME as if I she was doing me a favor and I owed her. I payed my payments on time and when I asked for a few days extra to handle a personal emergency they(Lucy and Ray) called me screaming and yelling that Lucy does "everything" right and I am to never put words in her mouth (wtf) first of all she "did tell me if something happened and I was in good standing (which I was) I could call them and they would work with me.....yes, I got a nice car but ask for Jose if you go to purchase...Lucy is not the person you want to deal with....
