I brought an item (Carpet Cleaning Machine) that I had sold on Ebay into the UPS Store located in Plaistow, NH. I paid $129.69 for packaging and shipping. The item arrived at its destination damaged and was refused by the recipient . A damage claim was initiated by the recipient, and the item was picked UPS. The disposition of the claim, was that the item was not packaged properly and as such denied. The item was returned to the UPS store in Plaistow, NH. I as the seller had been in contact with the UPS store owner and was assured that I would be contacted as soon as the item arrived. The store failed to contact me as promised. When I called the store on the 28th I was I was told that a new claim had to be initiated by the store before I could have my item. I called UPS that same day and was told that the new claim had been initiated and resulted in a reversal of the origanal claim. I was still told that I could not have back my damaged item until UPS decided if the wished to keep the damaged item as compensation for the yet to be dispersed $100.00 minimum declared value. I was told this process could take several business days. It would appear that I as the owner of item had lost all claims of ownership and had no say in the disposition of the item damaged or otherwise. At this point, against E-bay advise and protocol (I was advised by E-bay not to issue a refund until I was in possesion of the item) I elected to refund the buyer. At this point I am now out the sell price, the shipping and packaging cost and the item in question.
